[Latest] Circular 02/2024/TT-BTTTT regulating the List of potentially unsafe products and goods under the management responsibility of the Ministry of Information and Communications

On March 29, 2024, the Ministry of Information and Communications issued Circular 02/2024/TT-BTTTT amending and supplementing Circular 04/2023/TT-BTTTT dated May 31, 2023 regulating the product list causing loss of safety are the responsibility of the Ministry of Information and Communications. The Circular takes effect from May 15, 2024.

To understand the latest updated regulatory information for products, goods, telecommunications and information technology equipment, Dt&C VINA would like to inform customers and partners of the content of Circular 02/TT-BTTTT of Ministry of Information and Communications is as follows:

Pursuant to the Law on Product and Goods Quality dated November 21, 2007;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Radio Frequency dated November 23, 2009; Law amending and supplementing a number of articles of the Law on Radio Frequency dated November 9, 2022;

Pursuant to the Law on Information Technology dated June 29, 2006;

Pursuant to Decree No. 13/2022/ND-CP dated January 21, 2022 amending and supplementing a number of articles of Decree No. 132/2008/ND-CP dated December 31, 2008, Decree No. 74/2018/ ND-CP dated May 15, 2018 of the Government detailing the implementation of a number of articles of the Law on Product and Goods Quality and Decree No. 86/2012/ND-CP dated October 19, 2012 of the Government regulating detailing and guiding the implementation of a number of articles of the Law on Measurement....

At the request of the Director of the Department of Science and Technology, the Minister of Information and Communications issued a Circular stipulating the List of potentially unsafe products and goods under the responsibility of the Ministry of Information and Communications, replacing Circular No. 04/2023/TT-BTTTT issued on May 31, 2023.

Dt&C VINA outlines a number of updated amendments and supplements compared to Circular No. 04:

For Appendix I - Products and goods requiring mandatory Certificate of Conformity and Declaration of Conformity:

1) From July 1, 2024

Regulations apply QCVN 55:2023/BTTTT, QCVN 110:2023/BTTTT, QCVN 111:2023/BTTTT, QCVN 117:2023/BTTTT to products corresponding to HS code specified in the Circular.

Certificate of conformity according to: QCVN 117:2020/BTTTT, QCVN 110:2017/BTTTT, QCVN 111:2017/BTTTT, QCVN 55:2011/BTTTT is still valid until the end of the term of the certificate, including complete the application for state quality inspection according to QCVN 117:2023/BTTTT, QCVN 110:2023/BTTTT, QCVN 111:2023/BTTTT, QCVN 55:2023/BTTTT.

Terrestrial mobile communication terminals other than mobile phones must use E-UTRA (4G) technology. Certificates for these types of products (only integrated 3G, 2G, 2.5G) according to QCVN 117:2020/BTTTT continue to apply until the validity period of the certificate expires but not later than June 30, 2024.

2) From May 15, 2024 to June 30, 2024

Regulations to stop applying technical requirements in harsh conditions for QCVN 55:2011/BTTTT, QCVN 110:2017/BTTTT, QCVN 111:2017/BTTTT, QCVN 117:2020/BTTTT.

May apply :

  • QCVN 117:2020/BTTTT or QCVN 117:2023/BTTTT (effective from February 15, 2024)
  • QCVN 110:2017/BTTTT or QCVN 110:2023/BTTTT
  • QCVN 111:2017/BTTTT or QCVN 111:2023/BTTTT
  • QCVN 55:2011/BTTTT or QCVN 55:2023/BTTTT

For 5G mobile information terminals, apply both QCVN 127:2021/BTTTT and QCVN 129:2021/BTTTT. The certificate of conformity for this device is only according to 1 of 2 valid standards and will continue to be applied no later than June 30, 2024.

3) From May 15, 2024 Regarding QCVN 101:2020/BTTTT, it only applies to mobile phones that use removable Lithium batteries or are included/installed in the device (which is an inseparable part of the device).
4) From May 15, 2024 to June 30, 2025

It is not mandatory to apply technical requirements in harsh conditions for QCVN 117:2023/BTTTT, QCVN 127:2021/BTTTT, QCVN 129:2021/BTTTT, QCVN 41:2016/BTTTT, QCVN 16:2018 /BTTTT, QCVN 110:2023/BTTTT, QCVN 66:2018/BTTTT, QCVN 111:2023/BTTTT, QCVN 122:2020/BTTTT, QCVN 37:2018/BTTTT, QCVN 43:2011/BTTTT, QCVN 44:2018/ BTTTT, QCVN 42:2011/BTTTT, QCVN 55:2023/BTTTT, QCVN 123:2021/BTTTT, QCVN 54:2020/BTTTT and QCVN 65:2021/BTTTT (Only for products that are not wifi receiver-transmitter devices).

For single technology base stations of type 1-C, 1-H, technical requirements under harsh conditions QCVN 128:2021/BTTTT are discontinued. For single technology base stations of type 1-O, 2-O, all QCVN 128:2021/BTTTT will be discontinued. However, the importer must simultaneously declare and commit to the type of fifth generation mobile communication base station equipment (types 1-C, 1-H, 1-O, 2-O, multi-technology ) in the quality inspection registration dossier.

 

Other notes:

  • Broadband data transmission devices, stand-alone radio access devices operating on one or more bands that support the 6 GHz band (5.925 GHz to 7.125 GHz) (referred to as wifi devices 6E, 7) and Devices with integrated functions of wifi devices 6E, 7 can only be certified and declared conformity with the condition that the manufacturer has a written commitment to turn off the 6 GHz band and the user cannot Activate and use this band without the manufacturer's support.
  • For QCVN 117:2023/BTTTT, the requirements for Total Radiated Sensitivity of the Receiver (TRS) in Article 2.2.12 and Total Radiated Power (TRP) in Article 2.2.13 of the standard have not been applied.
  • For QCVN 131:2022/BTTTT, the requirements for Total Radiated Sensitivity of the Receiver (TRS) in Article 2.2.12 and Total Radiated Power (TRP) in Article 2.2.13 of the standard have not been applied.

  • For QCVN 132:2022/BTTTT, in case products and goods use a voltage converter (adapter), if the adapter is included, test QCVN 132:2022/BTTTT for products and goods that come with the adapter; If the adapter is not included, test the product without an adapter.

For Appendix II - Products and goods requiring mandatory declaration of conformity:

1) From May 15, 2024

For TV screens with integrated DVB-T2 digital terrestrial television signal reception (iDTV) function - QCVN 63:2020/BTTTT:

- Can use test results of different television receivers if using the same chassis/platform to make declaration of conformity.

- Technical documents of the type of television set announced as conforming to regulations/registered for quality inspection must fully show the chassis components, along with their codes.

- Manufacturer's commitment document for television receivers using the same chassis, with a list of television receivers using the same chassis with the codes of the same chassis components.

- Test results of a type of television receiver in the list of television receivers using the same chassis can clearly show their model number.

2) From May 15, 2024 to June 30, 2025

 

Suspension of technical requirements under extreme conditions  of QCVN 53:2017/BTTTT.

Stop applying all QCVN 38:2011/BTTTT, QCVN 39:2011/BTTTT, QCVN 24:2011/BTTTT, QCVN 26:2011/BTTTT, QCVN 28:2011/BTTTT, QCVN 50:2020/BTTTT, QCVN 57 :2018/BTTTT, QCVN 108:2016/BTTTT, QCVN 58:2011/BTTTT, QCVN 60:2011/BTTTT, QCVN 62:2011/BTTTT, QCVN 68:2013/BTTTT, QCVN 107:2016/BTTTT, QCVN 52: 2020/BTTTT, QCVN 59:2011/BTTTT, QCVN 61:2011/BTTTT, QCVN 123:2021/BTTTT.

 

3) From May 15, 2024

For radar equipment used for imported seagoing vessels that are exempt from quality inspection according to Resolution 99/NQ-CP dated November 13, 2019 of the Government, they must still declare their conformity before being put into use.

Radar equipment used in road or rail traffic (operating in the 76 GHz - 77 GHz frequency band) only needs to make a declaration of conformity according to QCVN 18:2022/BTTTT (remove QCVN 124:2021/BTTTT).

Wireless charging devices only need to make a declaration of conformity according to QCVN 96:2015/BTTTT.

 

Other notes:

Do not use measurement/test results from domestic or foreign testing laboratories that have not been designated or recognized or the manufacturer's measurement/test results to evaluate compliance with standards. following technical specifications: QCVN 123:2021/BTTTT, QCVN 74:2020/BTTTT, QCVN 52:2020/BTTTT, QCVN 57:2018/BTTTT, QCVN 50:2020/BTTTT, QCVN 116:2017/BTTTT, QCVN 53:2017 :BTTTT, QCVN 132:2022/BTTTT.

In addition, Circular 02/2024/TT-BTTTT has the following new points:

1) Exemption from certification of conformity and declaration of conformity for products and goods in sections 1 and 2 of Appendix II (such as desktop computers, laptops, tablets...) integrate short-range radio equipment in section 2 of Appendix I (such as DECT phone...) or section 4 of Appendix II and do not integrate other radio transmitters and receivers if they meet the following requirements at the same time:

  • The importer's internal self-use purposes.
  • Import a maximum of 3 products and goods for each category in one shipment.
  • Products and goods have operating bandwidth and technical specifications as prescribed in Circular 08/2021/TT-BTTTT dated October 14, 2021.

2) Exemption from certification of conformity and declaration of conformity to QCVN 101:2020/BTTTT, QCVN 132:2022/BTTTT, the content of the regulation requires destructive testing of samples for regulated products and goods specified in sections 1 and 2 of Appendix II if they meet the following requirements at the same time:

  • Import a maximum of 3 products and goods for each category in one shipment.
  • The importer must have a written commitment that the product complies with part/entire standards with destructive testing and is fully responsible for the safety of that product.

3) Only accept dossiers of certification of conformity and declaration of conformity for products and goods with HS codes specified in this Circular.

4) For some cases of suspension, partial/full application of some technical regulations is not required until June 30, 2025 (listed in detail above), if enterprises that have performed certification of conformity and declaration of conformity in the previous period from July 15, 2023 to June 30, 2025 and plan to continue production and import must carry out additional certification of conformity, declaration of conformity according to corresponding technical regulations or certification, declaration of conformity with new regulations from July 1, 2025.

5) From January 1, 2024 to before May 15, 2024, importers and manufacturers can choose to complete dossiers announcing conformity and register for state quality inspection of imported goods for with QCVN specified in Circular 04/2023/TT-BTTTT dated May 31, 2023 and Circular 10/2023/TT-BTTTT dated September 5, 2023 or according to the provisions of this Circular.
